(Merced County, California)  The Badger Flats Gazette notified members of the California District Attorneys Association (CDAA) of a recorded conversation with Merced County District Attorney Larry Morse, II and myself, Gene Forte.

Morse emphatically states several times during the conversation that if he investigated or filed charges against me he would be violating his ethical duties as a prosecutor, and California statutory codes.

WHY DID DA MORSE FILE CHARGES HE SAID HE COULDN’T?

Morse stated the reason why the conflict existed was due to the fact that:

1.  Morse was the defendant and I was the plaintiff in the civil Case Management Conference I was arrested at.  Months before my impromptu arrest Morse and his offices had been sued by me alleging that they were looting the Underground Storage Tank Fund with clean-up contractors.

2.  Five of his Assistant Deputy DA’s were witnesses to my arrest which would need to be investigated and charged.

3.  Morse discussed the  conflict with all of the Deputy DA’s in his offices and with DA’s in other counties and they all agreed that he had a illegal conflict that prevented him from either investigating or filing charges against me.

Let's think about this for a moment!

The questions put to members of the  California District Attorneys Association are:

1.  Should Morse, after stating that he had  such conflicts, have investigated charges or filed charges against me?

2. Has Morse committed prosecutorial misconduct?

3.  Should Morse continue to be on the Board of Directors of the CDAA?

4.  Is Morse fulfilling the CDAA mission statement “To promote justice by enhancing prosecutorial excellence” and motto “There is more to being a prosecutor than getting a conviction”?

5.  Should Morse be investigated by the California State Bar for breaching his ethical duties as an attorney?

6.  Has Morse committed acts against me which would be considered abuses done under the color of law?

7.  Should Morse be investigated by the California Attorney General’s Office?

DA CHIEF INVESTIGATOR SAYS “NO CALLS BACK” BECAUSE THEY HAVE A CONFLICT?

To put a cherry on top of the problems for Morse, his Chief Investigator Patrick Lunney told me on February 6th, 2012 that he was told by Morse not to call me back concerning my criminal complaint of the destruction of the 2009 Merced County Sheriff’s Department Citizen Complaint for false arrest and police brutality due to their conflict.

Listen to Lunney and I in the raw while he is performing his duty as a DA Chief Investigator.  I  did appreciate Lunney speaking with me even though he had not responded to any messages or faxes sent to him for over a month.

Lunney tells me that the DA’s office has a conflict and has had one since before filing the charges against me in September 2009!

Lunney also says that because of this conflict, he cannot investigate any criminal complaint I file against law enforcement,  but, he is NOT going to refer it out to anyone else?

Lunney told me he was going to talk to Morse, and then call me back.  Is he really going to call me back?  Or is he going to be transferred to some Antarctic outpost?

Here’s the brain freeze…so if they had a conflict existing before my arrest, how can they be prosecuting me now, with a trial coming up on March 20th, 2012?

They can’t!

MORSE REFUSES TO INVESTIGATE FORTE’S FALSE ARREST AND ASSAULT BY DEPUTIES

Obviously, Morse’s opinion is, we don’t have any conflict prosecuting Forte, we only have a conflict investigating any crimes by law enforcement done to Forte which would reveal that our prosecution is vindictive and retaliatory.

I am hoping that the CDAA does not want to step into the same ring of fire Morse has pulled the  Merced County DA’s Office,  law enforcement of Merced County, and judicial officers of the Merced Superior Court into.

Hope springs eternal for me.. and I am searching for a honest law enforcement agency out there to put an end to this law enforcement cabal against me.

Dylan Morse sentenced to 12 years for vehicular manslaughter a few days prior to Morse Forte 07/31/09 conversation. Dylan's extraordinary reduction of sentence to three years took place 3 months after Morse files charges against Forte.

I was sincerely concerned about the pain Larry was going through with his son Dylan who had just been sentenced to 12 years for vehicular manslaughter.

On the record, even though Larry has closed his eyes to what he has  gotten himself into,  and what he is doing to me, he knows that I am still compassionate to him.

Larry knows that I have stated publicly that he cut a deal with the powers that be to file false charges against me in order to get his son’s sentence reduced to three years.

I even told him that perhaps I might have done the same in his position.  But, even though I understood, it does not mean that I will not hold him accountable for doing it.

After I was arrested by who I call Deputy Chris “Mad Dog” Picinich on February 24th, 2009, Larry still had no problem putting his arm around me in the presence of hundreds of people including Merced County Sheriff Mark Pazin and having his picture taken on April 1st, 2009.

At the time, I was a person out on $117,000.00 bail for two felonies for allegedly attacking a judge.

Morse assured me that all of it would go away provided I didn’t file litigation against Deputy Picinich for what he did.

Perhaps that could have been in the cards then….but when Picinich attacked me a second time on July 31st, 2009 in a courthouse lobby…and slammed my head against a door when handcuffed, Morse knew I would not let it go.

Mind you that about a month later, Morse filed criminal misdemeanor charges against me.

Why in the world would Morse file misdemeanor charges (I was arrested for three felonies) after telling me he couldn’t and continue the prosecution for now close to three years?

The answer is  simple…. things just got way out of control.  It boiled over when Mayor Tommy Jones had a juvenile send me death threats after I busted him with the FPPC in January 2010.

Here’s a short list of the benefits for Morse and the good old boys he is covering for with an all out vindictive prosecution and assault upon my civil rights:

1.  Got his son Dylan’s vehicular manslaughter sentence drastically reduced by Judge Gnoss in Sonoma County.

2.  Covered for Sheriff Mark Pazin’s Deputies’ stupid brutal attack upon me.

3.  Discredit me to the public at large with the aid of McClatchy Newspapers so the corruption I brought out in Merced County and Monterey County would have less impact.

4.  Turn the heat away from Mr. Leon Panetta’s Monterey County good ol’ boys that I had been nailing in court with winning appeals.

5.  Take the heat off of ex-attorney General Bill Lockyer who pulled some dirty tricks trying to cover for Panetta’s boys.

6.  Dampen the impact of the BFG being credited for busting Mayor Tommy Jones with the FPPC for taking undisclosed loans (bribes) from Ranchwood Homes Developer, Greg Hostetler.  Jones was propagating that I was a dangerous member of the KKK.

Jones told that to my best friend of 40 years, best man at my wedding to my Chinese American wife,  Mr. Clinton E. Galloway, a fellow African American.

7.  Divert me away from exposing the tactics of roving circuit prosecutor Matt Maclear in demanding un-needed remediation of alleged MTBe under threat of criminal prosecution so that county agencies could drain millions of dollars from the Under Ground Storage Tank Fund with the multi-billion dollar environmental clean-up firm such as Tetra Tech, Inc.

Injuries suffered after having my head smashed into a door after being handcuffed by Deputy "Mad Dog" Picinich.

Morse was told that I had the audio recording of my head being bashed against a door while handcuffed.

Morse knew that I had recordings that would prove that the officers lied in their police reports.

Is the CDAA going to close their eyes and ears and pretend there is not something drastically wrong here?

Are they willing to put in jeopardy their own reputations and the  integrity of all District Attorneys in the State of California?

We’ll see.

I ask for them to respond for their own self dignity.

Note:  One would think that Larry Morse, II, should either voluntarily resign his position, or be asked to step down as a member of the Board of Directors of the CDAA.

On January 20th, 2012, I sent out emails to 45 FBI Offices Nationwide about Secretary of Defense Leon Panetta.

I told the FBI that Panetta was helping to conceal an attack upon me by public officials  because it leads back to Panetta’s boys in Monterey County……..and then voila, CBS 60 Minutes does a puff piece on Panetta!

The FBI was informed that US Attorney Benjamin Wagner told the Fresno FBI not to investigate abuses done under the color of law to me by Merced County officials.

I provided a copy of the conversation I had with the Fresno FBI to the Department of Justice, Office of the Inspector General, so they can hear the FBI Agent tell me that themselves!

It is more than clear FBI Agent Robinson is covering up for Merced County public officials.  I urge you to listen to them.

Don’t be fooled by what the FBI Agent is saying.  He’s lying through his teeth.  It is outrageous!  The missing Citizens Complaint is a crime under CA Penal Code 832.5.

Just because I have a civil litigation going on against the Merced County officials in no way pre-empts a criminal investigation of them for false arrest and abuses done under the color of law.  My civil rights are being assaulted.

“The FBI is the lead federal agency for investigating color of law abuses”… taken directly from the FBI Website.

Citizens have no way of pursuing criminal charges against public officials….that is what the FBI is for.  I wasn’t talking about them “blowing me off” as the FBI Agent tries to say.

I was reporting that they destroyed a Merced County Sheriff’s Citizen Complaint so there would be no investigation of it in order to conceal their assault upon me.

The FBI Agent is peeing on me and expects me to believe it’s rain.

I am being falsely prosecuted in retaliation for exposing public corruption that leads back to Panetta’s home county.

If  there have been any doubting Thomases visiting the Badger Flats Gazette,  I hope they make the connection.

It’s not a coincidence.

I submit that it supports what I have been telling you.  The media is controlled by the government.  It is controlled by Panetta.

While Panetta is flying around with his finger on the button that can launch World War III….preaching democracy….and blowing the hell out of any country that oppresses their people….he is the worst hypocrite of all.

Panetta has been coordinating a media blackout with McClatchy Newspapers about what is being done to me for his own self preservation.

It is being done to cover the trail of evidence I have which leads back to Monterey County, and his good ol’ boys stealing hundreds of millions of dollars under the guise of protecting citizens.

It leads to judges and law enforcement friends of Panetta raiding companies such as David Nilsen’s Cedar Funding Mortage by yelling Ponzi Scheme, when there was no evidence there was one, to get their hands on $200 million.

The good ol’ boys arranged with the Monterey Herald a public burnt offering of Nilsen to deflect attention away from the real culprits of the collapse of Cedar Funding…themselves.

The raid was headed up by now ex-Sixth Appellate Court Justice Wendy Duffy’s husband, Tom Duffy, with another scurrilousness attorney, Mr. Larry Lichtenegger.

Duffy walked away with millions in attorneys fees while the supposed “defrauded” investors’ got pennies on their investment dollars.

It is Tammany Hall Montery Style, with Panetta as ‘Boss Tweed”.

Panetta intends to be President Boss Tweed of the United States.

Nilsen ended up pleading guilty and is being sentenced to eight years so as not to face a potential sentence of 30 years if he went to trial.

Nilsen’s attorneys said they knew of the public corruption in Monterey County by the attorneys, Judges and public officials setting up a rip-off of Nilsen’s company  like they did, but weren’t going to say anything about it.  Would you trust those attorneys going to bat for you at trial?

I wouldn’t..and neither did Nilsen.

The reason is because they all profit from the  corrupt game that Panetta presides over  in Monterey County.

Panetta is involved in an assault upon a citizen, me, for exposing public corruption on his home turf of Monterey County since 2002.

It is as bad as the darkest days of oppression in Russia.

McClatchy Newspapers is keeping concealed from you the attack upon me for exposing public corruption that leads back to Panetta.

Are you going to stand by and let this happen?

Why don’t you just pick up the phone?

Call any local media station.

Ask them, why aren’t they saying a word about what you are reading here?

Panetta is slowly destroying the credibility of the United States worldwide by not addressing what I am accusing him of publicly.

Panetta was outraged saying that Marines urinating on the Taliban would endanger our troops and dignity of the US.

What Panetta is doing is far worse.  Do you believe Panetta and the government does not know what I am accusing them of?

All they have to do is prove me wrong.  Ask yourself why they are not doing so?

Do I need to end up dead first?

Then of course afterwards, most of the Gutless Wonders will remain Gutless Wonders and do nothing.

Panetta is endangering all Americans.  Don’t let it happen any longer.

If you let them do it to me…they will know they can do it to you!

I and my family have done much for our country in fighting against the corruption I stumbled upon in Monterey County. I am now asking my country, journalists, and citizens to bring this battle to an end. I simply ask that what evidence I have be addressed publicly for all Americans.

Preface:  You hear repeatedly that one man can make a difference, one man can change a nation, one man can conquer even over staggering odds..if they have right on their side.

Well, I’m here to say in my case it wasn’t one man.  It was me, along with my wife Eileen and children Gabrielle, Jordan, Noel and Juston.

Today, I am claiming publicly that the timing of the arrest of Connecticut Police officers by the  FBI was triggered by my actions of the past days.

The timing of the FBI arrest was not a mere coincidence in connection to my activities of the past days.  It was a direct reaction to the heat that is coming down the pipe toward them.

Let me make clear what I am saying.

I am not saying in any way that because of my actions across the last few days that the FBI just went out and arrested the Connecticut police officers…or that I somehow triggered the initial investigation.

The investigation of the police officers has assuredly been going on for some time.  I had nothing whatsoever to do with it.

I am specifically saying that due the pressure I have exerted across the FBI network of exposing that the Fresno FBI office has not been addressing the solid evidence of crimes against me by Merced County law enforcement agencies they work with…that the FBI decided it was an opportune time for a good PR splash.

It was time for the FBI to put out to the public that the New York FBI had been brought in to work with the Connecticut FBI because the FBI didn’t want there to be any appearance that the Connecticut FBI could be concealing crimes by the Connecticut PD they work with.

I’m saying the Fresno FBI has been covering up for the law enforcement officials they work with.  (As I’ve said before, it is well touted and known in the City of Los Banos that Chief of Police Gary Brizzee went to “FBI training” courses in Fresno.)

The FBI offices in Sacramento, San Francisco, San Diego, and Los Angeles, have not ridden in to save the day by making sure my rights were not violated by the Fresno FBI.  It appears that the Fresno FBI was covering up the crimes by public officials against me, and other CA FBI offices are allowing them to do so.

The reason why the other California FBI offices have not addressed the illegal acts by the Fresno FBI is because, not only do I  have the Fresno FBI by their short hairs…I also have the US Attorney Benjamin Wagner, Attorney General Kamala Harris,  Federal Judge Anthony Ishii, and Leon Panetta caught also trying to conceal the crimes against me.

With that said, here are some of the things I have done these past few days:

1.  120117 Ltr to FBI Internal Affairs Washington DC with 111228 ltr to FBI:   I filed a complaint with the Washington, D.C.  FBI Internal Investigations about the Fresno FBI covering up crimes of Merced County officials.

2.   January 20th, 2012:  Sent emails to 40 FBI Offices across the nation with the conversation I had with Fresno FBI Agent Robinson indicating that he was not investigating solid evidence of crimes by Merced County officials against me.  I requested that they have neutral FBI Agents come into to address the matter

3.  January 22nd, 2011:  Sent links to 6,000 attorneys in California about sending the emails to FBI offices.

4.  January 22nd, 2011:  Sent links to over 85 media outlets about sending the emails to the FBI.

THE INTEGRITY OF ALL FBI OFFICES  HAVE BEEN CALLED INTO QUESTION BY

THE FRESNO FBI

NBC Connecticut The East Haven Police Department is under investigation by the U.S. Justice Department.

Just two days after I sent emails to 40 FBI Offices nationwide, including the New York FBI and the New Haven Connecticut FBI, a national story broke in the New York Times and NBC New York concerning both offices.

It was reported that the FBI arrested three Connecticut police officers and one sergeant for allegedly mistreating Latino suspects and residents while on patrol.

The article went on to say:

“The investigators say that the officers are charged because they worked “to injure, oppress and intimidate various members of the East Haven community.

Prosecutors say the officers denied Latino residents and their advocates the right to be free of unreasonable searches and seizures, the right to not be arrested and detained without probable cause and to not be arrested on false and misleading evidence.

The officers also are accused of harassing and intimidating individuals, including advocates, witnesses and other officers who tried to investigate or report misconduct or abuse committed by the four officers.

The arrests of the law-enforcement officials come weeks after the Justice Department issued a report saying some members of the department intentionally targeted Latinos for enforcement and traffic stops, and that there may have been efforts to cover up the alleged misconduct. 

The New York FBI joined in the investigation to avoid any appearance of a conflict by the FBI Connecticut, which works closely with local police departments. An FBI New York spokesman declined to comment. 

Let me cut to the chase.

I have bolded words from the article to emphasis how precisely it relates to what I have been submitted to by Merced County Law enforcement.  I have been under attack by them for exposing public corruption here in Merced County and Monterey County.

The Fresno FBI that has jurisdiction over Merced County peace officers and public officials have been covering up the crimes against me for them.

The emails I sent out to the FBI Offices with the conversations I had with the Fresno FBI Agent Robinson pleaded with them to address the matter of the assault upon me that the Fresno FBI has been covering up.

If the Connecticut FBI had to bring in the New York FBI in order to avoid the appearance of a conflict due to their working with the Connecticut Police Officers, the Fresno FBI certainly should have done the same.

But, they did not…and now all of this is coming back to haunt them.

The Fresno FBI has ignored the cimres by the law enforcement officers they work with as a favor to them.

The major problem that the FBI now has is that every FBI Office in Califonia has been involved in ignoring the attack upon me by public officials that they know has been covered up by the Fresno FBI Office….along with the California Newspapers.

McClatchy Newspapers is head deep in this along with every other media source that has not said a word about the attack upon me.

McClatchy Newspapers has been orchestrating a media blackout of what they and public officials have been doing to me. They are doing it because I have them connected to covering up for Leon Panetta's cronies in Monterey, California.

There has been a California Media blackout orchestrated by McClatchy Newpapers.

CBS 47, and KMPH TV 26 have deleted my emails sent to the FBI.

The way it works is that the NBC New York media will place a call to their California media contacts.

The California media contacts will say something along the lines of,

“Oh, yeah, we know about that Gene Forte.  There is no story there.  He’s a nut!  He’s even sued McClatchy Newspapers saying they are covering stuff up.  Stay away from him”, or words to that effect.

It has gotten to be an old worn out story that just doesn’t wash anymore when a neutral party looks at the evidence I present.

When mad dog Deputy Picinich along with some other officers falsely arrested me and brutalized me, they made a big mistake.

It wasn’t something that Leon Panetta, or my higher up adversaries, had planned on.

It was a vicious act by some officers that actually thought, after reading my Badger Flats Gazette, that these public officials were just going to tear me up when they “got me in a courtroom”.

Not so.  The public officials didn’t want to be put in a position to have to confront the evidence I have against them.

It is the beginning of the end of Leon Panetta’s career, and a start of a cleansing of corruption in California the like of which has never been done before.

I have already contacted NBC New York in the hopes they are going to address what has been happening to me here in California….whether they do so is a question left to be answered.

I am in the hopes that they will not buy into the McClatchy spin machine without giving me even the opportunity to present my side of the story and evidence.

I am now like the man in Tiananmen Square holding back the tanks. The tanks are driven by the public officials of Monterey and Merced County. They are being fueled by the Fresno FBI covering up the attack on me for exposing public corruption. The tank commander is Mr. Leon Panetta.

Like I said, I submit to you that the timing of the event coincides with my pressure being brought upon the Fresno FBI Office.

The media on the East Coast is making a big to-do about what is of course an important story.

The story is being fed to them by government and FBI spin masters.

It tends to have one think that if my story was legitimate, the media here in California would be printing about it.

It tends also to have one think that the FBI would be all over the Fresno FBI like white on rice.

I submit again that the story and evidence I have is going to take down a number of law enforcement officers in Merced and Monterey County.

My story exposes that McClatchy Newspapers has been involved in orchestrating a cover up.

My story shows how Leon Panetta can be hoisted to be Secretary of Defense by McClatchy Newspapers by his concealing the corruption of his home town cronies while I am attacked.

It calls into question what the media in the entire nation is doing if they don’t talk about my story.

Let’s see what is going to happen!

The story is about myself, a citizen, that is under attack for exposing public corruption.  I can go infinitum with details and proof.

But I respectfully submit that if what I am saying is EVEN HALF true, it is equal to or far greater than the Connecticut story.

My civil rights are under attack because I have reported upon public corruption.

I have evidence about public corruption in Monterey County, home to Secretary of Defense Leon Panetta, that Panetta does not want out.

It is the tale of  skeletons rattling in a closet coming back to haunt Panetta.

It is an all consuming fire that has been building for ten years that implicates judges,  law makers and politicians.

I am being punished as much and even more than the Latinos in Connecticut.  If it is allowed to take place to me, every American, no matter what race, color, or creed, will be in danger of it happening to them by the government.

I really do not consider myself to be a journalist.  I am a person that had to pick up a pen to fight back for the protection of  myself and my family.  If I had not picked up a pen, many people think I would have already been found dead in a ditch.

I am not a political activist.  I don’t even vote for god’s sake!

It started in 2002 when I caught attorneys from the law firm Fenton & Keller fixing trials with my own attorney in Monterey County.  The firm employs Leon Panetta’s son, Christopher Panetta.

Panetta called me up and issued me a veiled threat to stop, or I would regret it.  Since that time, though unknown to the public at large,  seven Monterey judges have retired due to me.

The Monterey Herald (then McClatchy Newspapers) intentionally reported that I had been declared a California vexatious litigant just a few days after a national story about me was published concerning catching a Monterey Judge Michael Fields in a very compromising position that led to his early retirement.  You will notice in the article of Fields’ retirement there is no mention of me.

It was a Sunday front page 2000 word hit-piece  article on me.  While the Monterey Herald (MH) said my legal writings were rambling and flippant, they failed to tell the public that I had overturned the ruling of Judge Robert O’Farrell that had arrested me in a courtroom when I disqualified him with a CCP 170.6.

O’Farrell just a few days before the hearing he arrested me at read my opening brief of his ruling of the case I  said he fixed with the Law Firm of Panetta’s son (it was ultimately the appeal that I won).  O’Farrell was not suppose to be presiding over the case.

The MH knew that I not only defeated the motion but that the retired Judge John Golden found that AG Lockyer and Governor Schwarzenegger had no grounds to bring it whatsoever.  It was like Harry Potter defeating Voldemort.

MH printed a Dec_16_2005_MH Correction buried in the newspaper.  Panetta was the main commentator for the MH.

If you are wondering about the reference to a letter from Ms. Sylvia Panetta wanting stamp postage here it is.  It wasn’t as Ms. Panetta claimed “large envelopes” that I asked her to mail to her Board of Directors as can be seen from my response to her.

After I had a heart attack in a Monterey Courtroom the day after I won an appeal that revealed the Monterey corruption (Cover page), I moved back to my hometown of Los Banos.  I was born to a farming family there.  I am now 59 years old.

I was still battling with what I call the Monterey County good ol’ boys and the Monterey Herald for doing the hit piece in Federal Court.

A prominent citizen in Los Banos that I had grown up with asked if I would look into what the Merced County DA was doing in pressuring him to hire a multi-billion dollar remediation firm to supposedly clean up his gas station of MTBe.

That led me to uncovering fraud by the Merced County DA draining money from the Underground Storage Tank.

Next, I filed a complaint with the Fair Political Practices Commission that caused Los Banos Mayor Tommy Jones to be found guilty of taking undisclosed loans from a developer.

Jones is African American and started spreading the rumor that I was a dangerous member of the KKK.  I am not.

Jones told this to Mr. Clinton E. Galloway, an African American, my best man at my wedding to my Chinese American wife.

Galloway has been my best friend for 40 years and I am considered a member of the Galloway family.  Dr. Carl Galloway passed away in my arms, and he and I shared many adventures together.

I ended up in a lawsuit against DA Morse which would expose the fraud concerning the Underground Storage Tank Fund.  I was falsely arrested while attending the lawsuit against DA Morse.

I was then falsely arrested and assaulted at another courthouse four months later by the same deputy when I went with my son to attend a traffic ticket hearing.

Morse had told me that all of the matter of the arrest would go away if I would not file litigation when he and I met cordially a few weeks after my first arrest.    I told him politely to go to hell.

DA Morse (on left) and I when I was out on bail for $117k for allegedly attacking a judge. Morse and Merced County Sheriff Pazin said the matter of my arrest would go away provided I didn't sue them for false arrest by the Deputy. I've got a audio recording to prove it.

Merced County DA Larry Morse in a recorded conversation admits that he could not file or investigate any charges against me (then files misdemeanor charges when I was arrested for felonies).

I have over 30 minutes of his admissions.

McClatchy Newspapers through a false Lieb commentary fostering the idea that I was a member of the KKK.

Lieb doesn’t say anything about me being part of a black family, or that I was delivering a message from the Galloways to Jones.

I did not call Jones a lying-n-word.

I asked to be able to respond to the commentary, or that they provide information that would accurately portray what took place.  There was no response.

I wrote about  Mayor Jones’ arrest for crack cocaine and received death threats from a student of Jones who said he did it for Jones.

McClatchy Newspapers did not say a word to the public about the death threats.

The death threats have been covered up by Los Banos Police Officers, Merced County law enforcement, and the Fresno FBI.

The links provided  show only the tip of the iceberg of the coordinated effort to malign me and discredit me by public officials with their spin machine, McClatchy Newspapers.

I am asking honest journalists to look at these matters and discuss them with me.

Please do not buy into the spin that McClatchy is putting out behind the scenes.

McClatchy needs to be held accountable to the nation and other journalists.

If they are not…..the integrity of every journalist and newspaper in the US will be in jeopardy.

You don’t have to buy into my side of the story.

I am willing to prove everything I say if given the opportunity.  I ask you to scrutinize both of us.

My daughter is now in her fourth year at Cal Berkeley, she graduated valedictorian of her class.

My son graduated last year from a Catholic High School with a 4.8 GPA, Class President, class valedictorian with eighteen academic awards and now is attending Duke University on a full scholarship.

My sophomore daughter is well on her way to be valedictorian of her class.  My eighth grade son already has his name on the gymnasium wall for top academic honors in the county academic pentathlon.  My wife and I have written winning appeals exposing the corruption.

With all of this said and done, these individuals attack me, and the FBI covers for them.  Not on my watch.

I am not a radical or an anarchist.

Prior to being put in a position to take Panetta on, I was making $565K a year as a high level retained executive recruiter.

I ran for Governor of California in the Recall race.   I was known as the Attorney Buster.  I  came in second to last.

I didn’t do it as a joke, but it was my way to try to communicate what was taking place in Monterey California.

Panetta called me three days before he announced that he was not going to run.

You may criticize me if you wish for trying to tell my own story, or the way that I am telling it, but there has been no one else to tell the story for me.

Yes, I have mocked these people publicly because their actions have become so absurd that the truth is unbearable… without the mocking.

As you will find from reading this article, your goose will be cooked if you file a false Citizen Complaint…but, the government AGENCY Gander that destroys it can waddle on down the road because the FBI Fresno Office isn’t going to enforce the law.

The laws that prevent the AGENCY from destroying it, or hiding it…Well, Golly Gee Gomer…it’s just an administrative error according to the Fresno FBI…and the laws that are to protect you from the government are not enforced.

There is a stern warning given citizens on the Merced County Sheriffs Department Citizen Complaint cover page which states,

“I declare under penalty that the foregoing is true and correct to the best of my knowledge and belief.  Per California Civil Code Section 47.5, a Peace Officer may bring an action for defamation against an individual who has filed a complaint with that officer’s employing agency alleging misconduct, criminal conduct, or incompetence, if that complaint is false, the complaint was made with knowledge that it was false and that it was made with spite, hatred, or ill will.  PER CALIFORNIA PENAL CODE SECTION 148.5 FALSE ACCUSATIONS AGAINST PEACE OFFICERS.

You are forewarned that they will nail your ass to the wall for screwing with them if you are not honest.

Next you’re informed on the Citizen Complaint that:

“CALIFORNIA LAW REQUIRES THIS AGENCY TO HAVE A PROCEDURE TO INVESTIGATE CITIZENS’ COMPLAINTS….CITIZEN COMPLAINTS AND ANY REPORTS OR FINDINGS RELATING TO COMPLAINTS MUST BE RETAINED BY THIS AGENCY FOR AT LEAST FIVE YEARS”

Then, for a second time,  you are reminded about your ass in relationship to a wall, and are told…

“IT IS AGAINST THE LAW TO MAKE A COMPLAINT THAT YOU KNOW TO BE FALSE.   IF YOU MAKE A COMPLAINT AGAINST AN OFFICER KNOWING THAT IT IS FALSE, YOU CAN BE PROSECUTED ON A MISDEMEANOR CHARGE”.

What you are not told is the criminal penalty to the AGENCY that does not conduct the investigation of your complaint, shreds it, or has it lifted out of the file by someone at the Merced County Counsels’ Office as in my case.

The AGENCY is in violation of California Penal Code Section 832.5 (b)  which states:

(b) Complaints and any reports or findings relating to these
complaints shall be retained for a period of at least five years. All
complaints retained pursuant to this subdivision may be maintained
either in the peace or custodial officer's general personnel file or
in a separate file designated by the department or agency as provided
by department or agency policy, in accordance with all applicable
requirements of law.

The AGENCY that warned you twice about your ass…when caught with its pants down in burying a Citizen Complaint is punishable under California Government Code Section 1222 which states:

"Every wilful omission to perform any duty enjoined by law
upon any public officer, or person holding any public trust or
employment, where no special provision is made for the punishment of
such delinquency, is punishable as a misdemeanor."

The Fresno FBI Duty Agent of December 28th, 2011, said that at worst, the losing of the Citizen’s Complaint would only be an “administrative error”.  That, my friend, is an outright, bald-faced lie.

It’s a crime if the purported  ”administrative error” is being used to cover up a crime against me of police brutality and false arrest.

It would be similar to a shoplifter walking out of the store with a bag full of items and saying, ” Shoot, I just forgot to pay for them!”.

To which of course the cop while placing handcuffs on you would say, “Tell it to the judge!”.

The missing NON-INVESTIGATED CITIZEN COMPLAINT is a Penal Code violation as can be seen from above.

Plus this was not just “any Citizen Complaint.”  It’s about the false arrests that I am being falsely prosecuted for with a trial set in March 2012.

Do you really believe that Merced County DA Larry Morse and Merced County Sheriff Mark Pazin didn’t know the Citizen Complaint filed by me in December 2009 was not investigated?

Here’s a portion of the conversation I had with Morse on July 31st, 2009 wherein we talked about my head being slammed against a door by Deputy “mad dog” Picinich.

It was the subject matter of my Merced County Grand Jury complaint.  It was the subject matter of the investigation that was tampered with by Merced County Counsel James Fincher.

Now, the two year old un-investigated complaint was found in Fincher’s office.  The FBI cannot connect the dots?   B.S.!

It is what I have been raising holy hell over for two plus years.

Justice always makes sure the government is right!

Therefore, the axiom applied by the Fresno FBI is  ”what is good for the citizen goose is not good for the government gander.”

Your goose will be cooked if you file a false Citizen Complaint…the AGENCY Gander that destroys it waddles on down the road.

Any neutral law enforcement agency reviewing the evidence I possess realizes there has been a complete breakdown of Merced County law enforcement to violate my civil rights.   The Fresno FBI has now joined in on the dog pile.

I am being treated as badly as a black person in the south turning the darkest days of American History.

Omaha FBI Agents Run Away!

 

Omaha FBI Agents running away from my emails!

Omaha FBI agents (being requested to address what appears to be the Fresno FBI Office ignoring color of law abuses by Merced County public officials) reacted quickly to the crisis.

It is reminiscent of a scene out of  Monty Python’s “In Search for the Holy Grail.”  You know, where everyone starts yelling, “Run, Away, Run Away!”.  

The chant of the Omaha FBI Agents is probably something like, “Quick, delete the email!  Delete the email.  It has evidence that Fresno FBI Agents are covering up for public officials.  Quick, Run Away!”

I’m not going to take much time telling you what oafs the Omaha FBI Agents are.  I’ll let their record speak for itself.

After the Omaha FBI Office read the first email and knew what the second email was about, they panicked and hit the delete button.

So, I cut and pasted email two  into their “FBI Tips and Public Leads Line“.

There is a stern warning on the Omaha FBI complaint website which states, “The information I’ve provided on this form is correct to the best of my knowledge.  I understand that providing false information could subject me to fine, imprisonment, or both. (Title 18, U.S. Code, Section 1001).  It’s similar to the warning given citizens when filing the Merced County Sheriff’s Citizen Complaint.

I found interesting that in the box reporting any criminal activity you need to keep what you are reporting to 3,000 characters.

Characters (as in letters), mind you, not words.

I’m sure Fresno FBI Agent Robinson supports the limitation.

One certainly does not want to overtax his mind with a “stack of words”.

Will the FBI Respond?

NOTICE:  On January 20th, 2012, I sent two emails to roughly 40 FBI Regional Offices across the United States which included the recorded conversations I had with Fresno FBI Agent Robinson.

I was reporting the disappearance and recent suspicious re-appearance of my 2009 Merced County Sheriff’s Department Citizen Complaint for police brutality and false arrest.

It was evidence of a crime with a purpose by Merced County officials directly connected to their assault upon me for exposing public corruption.

The Merced County Sheriffs Department violated California Government Code Section 1222 and committed a misdemeanor violation under California Penal Code Section 832.5 (b).

Listen to FBI Agent Robinson make out that since the two year missing Citizen Complaint was found,  it was no big deal.  Not so.

The matter is discussed in more detail below under “Behind the Scenes”.

I requested that the FBI Offices provide the conversations I had with Fresno FBI Agent Robinson to Robert Mueller, head of the FBI.

I have asked FBI Agents and Mueller to confirm that the Fresno FBI has either breached their sworn duty to investigate complaints of  color of law abuses by Merced County officials…or to affirm they would have treated me the same as FBI Agent Robinson did.

Will all of the FBI offices and their agents stick their heads in the sand?

Will the FBI affirm by not responding that they condone the handling of the complaint by Fresno FBI Agent Robinson?

Will the the FBI offices cover for the Fresno FBI?

Will the FBI attack me as they did their own Agent Jane Turner which she revealed theft of 9-11 items by the FBI?

On January 20th, 2012, I also left a voice message for US Attorney Benjamin Wagner that contained my conversation with Fresno FBI Agent Robinson.

Wagner had been left a message by me on January 6th, 2012, and then again on January 18th, 2012.

Obviously, Wagner, as most public officials, believes he is a god walking among mortals and did not call back.

The email with the conversations with Fresno FBI Agent Robinson was also sent to dozens of media outlets.

Will anyone report upon this story?

By the way, in  September 2011 the U.S. Court of  Appeals for the First Circuit ruled that Citizens can record police in performance of their duties…just in case you were wondering.  Now, I’m not giving you any legal advice..I’m just saying.

Why It's All Happening!

Since July 2009, I have provided evidence  to the Fresno FBI Office that Merced County law enforcement are covering-up that they falsely arrested and assaulted me at the Los Banos Courthouse and the Merced Courthouse.

They did it to intimidate me.  I was not a criminal defendant going to the courthouses for an arraignment, or to start trouble.

I was arrested at the Merced Courthouse when attending a Case Management Conference as the plaintiff  in the lawsuit I had against Merced County DA Larry Morse.

When I was arrested at the Los Banos Courthouse, I was about to attend a traffic hearing with my minor son.

During the past two years, I have provided the Fresno FBI with approximately 65 pages of evidence of:

1.  Information and audio recordings proving that I was falsely arrested and assaulted by the deputies.

2.  Grand Jury Tampering by Merced County Counsel James Fincher of the investigation of my arrest.

3.  Proof that the Merced County Sheriff’s Department Citizen Complaint about the  false arrest had not been investigated and disappeared.

4.  Confirming that the FBI Was Ordered Not to Investigate Color of Law Abuses by Merced County 

Fresno FBI Agent Robinson,  referred to the above as  a ” stack of information.”

There is no voluminous stack as you can see from the fax cover indicating the number of pages.

Agent Robinson was saying that just to be insulting and demeaning.

I am currently scheduled to go to trial in March to defend against the charges of my arrest.

Fellow FBI Agents....Run Away! Run Away! Forte is sending us emails!

Merced County DA Morse told me that no charges would be filed against me provided I didn’t file litigation against them for police brutality.

I told him in polite terms to go to hell.

The missing and now re-appearing 2009 Citizen Complaint for police brutality and false arrest is a crucial piece of evidence. It was missing for two years.

Then four days after I filed a criminal complaint with the Merced County DA Chief Investigator Lunney, it magically is found in the Merced County Counsel’s Office.

Just because they coughed it up after being tipped off by Lunney, it does not mean that the parties that caused it to go missing are not guilty of a crime.

It would be akin to bank robbers returning the money they stole when the police came to arrest them and said…okay…thanks for stopping by and the police say….no problem.

The Merced County Sheriff’s Department (Agency)  were required to investigate the Citizen complaint and keep it on record for at least five years.  They made it go missing so that they could continue to falsely prosecute me.

The Merced County Sheriffs’ Department is  in violation of   California Penal Code Section 832.5 (b)  which states:

FBI Agent Robinson kept on trying to marginalize the Citizen Complaint as a report that went missing that was now found…so there was no big deal.  Not so.  FBI Agent Robinson mocked me saying it was a conspiracy theory.  No, it was evidence of a conspiracy of a crime that was committed by Merced County officials.

It ties all of the acts by the public officials together.

It’s why the Fresno FBI is tucking tail and running.

The Fresno FBI does not want to be exposed for their ignoring the abuses done under the color of law to me  by the Merced County Good ol’ boys and for their real boss……..Leon Panetta of Monterey County, California.

Preface:  The amazing discovery of my missing 2009 Citizen’s Complaint for false arrest and police brutality indicates that perhaps the Merced County good ol’ boys (to save themselves) are opting to throw Merced County Deputy John Picinich and Los Banos Police Officer Anthony Parker under the wheels of the bus.

Maybe, they’re headed down the right track to having justice served and put an end to a very ugly chapter in my life.

But, until it happens, and it isn’t some trick, I hope you will continue to follow my public mocking of them.

The false arrest of me and the police assault upon me is no laughing matter.  These yahoos have had bogus criminal charges pending against me based on those false arrests for three years.

Get this…they originally arrested me for three felonies of allegedly attacking a judge at the Case Management Conference in my lawsuit against Merced County DA Larry Morse.  The bail was $137,000.00.

When I wouldn’t agree not to sue them for the false arrests and police brutality is when DA Morse filed misdemeanors charges he knew he couldn’t file to try and club me into submission.

Dear Sheriff Mark Pazin and Undersheriff Thomas Cavallero,

I received your letter of January 10th, 2012 today.  Excuse me while I exclaim…

”Well, holy bat sh-t Robin, can you imagine the coincidence! Only days after I filed a criminal complaint with the Merced County DA’s Office with Chief Investigator Patrick Lunney, you are able to pull my Citizen Complaint from December 2009 out of your derriere?”

When you responded to my inquiry letter of December 15th, 2011, with your two sentence letter of December 23rd, 2011, you stated:

 “I am in receipt of your inquiry dated December 15, 2011 (status of citizen’s complaint).  I have checked our records and am unable to locate any indication that a complaint had been made by you or that an investigation was initiated by this office.”

You didn’t ask or say something like, “Gee, Mr. Forte, what was the complaint about?

Do you have a copy of it?  I want to get down to the bottom of this.”

What’s your motto over there, “To protect ourselves and screw the public”?

Further, I asked you on December 23rd, 2011, via faxed letter and email to tell me why you didn’t have a copy of it.  It took you 18 days to come up with your B.S. cover that it was in the County Counsel’s Office!

You also came up with the 2009 Citizen Complaint after I filed my copy of it with the Federal Court, and after the FBI told me that they were ordered by the US Attorney not to investigate any criminal activities by the Merced County Sheriff’s Office of destroying the Citizen Complaint you now have miraculously found.

Panetta endangering United States' image by not demanding a probe of public corruption in his home town and state.

(Monterey County, January 13th, 2011) Leon Panetta, Secretary of Defense, made public his absolute disdain and outrage about US Soldiers urinating on the bodies of dead Taliban.

I actually agree with what I have to say is his feigned outrage….which is quite different from an honest outrage.

Anyone that has read my blogs knows that I consider Panetta to be nothing more than a two-party-two-faced hypocrite due to his covering up public official corruption in California.

With that said, I submit that Panetta should take into consideration the stupidity of youth.. especially when they are armed, dangerous, and thrown into a war setting.

Stupidity does not make it right,  or excusable for the Marines.  Their actions have endangered the lives of our troops.

Their crass actions will be used to stir up more hate against us.

But, Panetta is doing something far worse to endanger the lives of all Americans on a much grander scale.

He is playing Russian Roulette with the image of  the United States and what it stands for.

He’s doing so by not demanding a probe into the public official corruption in his home county of Monterey and State of California that I have been bringing to his attention since 2003.

Now, I know that Panetta used to urinate in Coke bottles when he was attending Santa Clara Law School, dye his urine with food coloring, and leave it for the incoming unsuspecting law school students.

Should Panetta be damned for eternity?   That’s a question to be determined between him and his god.  I personally think not….it was a youthful stupid prank.

Panetta is no longer youthful, and is a lead senior statesman for our country.

Until he does something about the corrupt public officials that have been attacking me for exposing them…I will continue to lambast him every chance I get.

Panetta should vent outrage  in the direction of the California public officials that I have cornered in his home town of Monterey, and their affiliate good ol’ boys in Merced County.

But, instead of venting on them….he is covering for them.

No government official has to believe on my word alone that I have uncovered corruption at the highest levels.  But they need to publicly address the evidence I have….and not treat me as if I don’t exist.  The US government cannot be permitted to do to me what tyrannical governments in foreign lands do to journalists that expose government corruption.

A document I filed recently in my Federal Court case against some corrupt California public officials alleged that Panetta was the puppeteer of US Attorney Benjamin Wagner who ordered the FBI  not to investigate any evidence of criminal activities by them against me.

Well, just like Popeye said, “I’ve had all I can stands, and I can’t stands no more.”

When you hear me refer to the “gifts in bottles” that he and his roommate used to leave, I was referring to his pee in Coke bottles.

When I said, “Yes I have,” it was in response to Panetta saying that I must have some very high level sources.

He was astounded at how I was able to gain such information.

I consider that a real compliment from the guy who would become the head of the CIA.

So… this is the guy that heads the Panetta Institute whose mission is “Inspiring Lives of Public Service for the Health and Future of our Democracy”?

What a crock!  You better be ready to get pissed on by Panetta and his cronies…with Panetta assuring you it’s just rain.

Panetta, it appears, is now keeping the crimes of public official cronies against me covered up by the FBI.

Heaven forbid that one of the public officials that I have exposed has someone put a bullet through my head.

Due to the evidence I have, what I have been trying to bring to the public’s attention, with the media and Panetta ignoring it, and the thousands of citizens that do know my story…it will be the end of Panetta’s Russian Roulette game for America.

The Taliban and other enemies of the US would have a field day proclaiming this is what America does to their own citizens that stand up to corruption.  This is what their own Secretary of Defense, ex-CIA boss, Panetta will have done.

The story will get out as it is slowly doing so now.

Is Secretary of Defense, Monterey County’s Leon Panetta the Puppeteer of Wagner stopping the FBI from investigating CA public officials? Read on to find out what Panetta wants to cover up for his good ol’ boy public official cronies in Monterey County. Does it start with his son’s law firm Fenton & Keller fixing trials with judges?

No, I’m not kidding!  Now, there’s a real kick to the lower part of a guy’s anatomy to start off the New Year!

To analogize how unlawful such instructions are, it’s akin to Wagner instructing all law enforcement officers not to stop swerving vehicles with government license plates suspected of drunk driving to avoid giving them DUI tickets!

The revelations of such dubious instructions by Wagner giving the Merced County official defendants a “commit what crimes you want card”  came to light when I contacted the FBI Fresno Office on December 28th, 2011.

I was calling the FBI to provide substantial evidence of criminal activity by the Merced County Sheriff’s Department defendants destroying my Merced County Sheriff’s Department Citizen Complaint filed on December 22nd, 2009.  The Citizen Complaint was requesting an investigation of my arrest and police brutality by the Merced County defendants.

The evidence I provided the FBI was a paint by the numbers violation of California Government Code Section 1222 that makes it a misdemeanor crime to destroy a Citizen Complaint.  It was a violation of the provisions of California Penal Code Section 832.5 (Citizen’s complaints against personnel; investigation; retention and maintenance of records; removal of complaints; access to records).

The evidence indicating that the Merced County defendants potentially committed the crime are the following three documents.

1.  The December 22nd, 2009  file stamped copy of the Merced County Sheriff’s Department Citizen Complaint filed by me.

2.  My December 15th, 2011 inquiry letter to Sheriff Mark Pazin requesting the status of my complaint.

3.  A December 23rd, 2011 letter received from Merced County Undersheriff Thomas Cavallero  informing me there was no record of  my Citizen Complaint, and that there was no investigation conducted.

The front page of the Citizen Complaint states that according to California Penal Code Section 148.5, I could be charged with a misdemeanor (just as any citizen), for filing a false accusation against a police officer.

It also states in bold print on its front page that “CITIZEN COMPLAINTS AND ANY REPORTS OR FINDINGS RELATING TO COMPLAINTS MUST BE RETAINED BY THIS AGENCY (meaning the Merced County Sheriff’s Department) FOR AT LEAST FIVE YEARS”.

When I told the FBI Agent I was Gene Forte, his first response was, “Your name rings a bell.  You’re the Badger Flats Gazette, right?”  I said, “Yes, that’s correct”…and prepared to get hosed.

The agent then began reading to himself aloud, “There’s special instructions attached to the file.  Let’s see, you’ve sued Merced County DA Morse, Sheriff Mark Pazin and others.  Oh yeah!  The US Attorney has  instructed us not to investigate any complaints of criminal conduct by the Merced County public officials that you have sued.”

(Note:  I sent a confirming letter of the substance of my conversation with the FBI Agent asking for him to correct any inaccuracies.  There has been no response.)

I wasn’t necessarily aghast by what the FBI Agent told me.  I have suspected for about a year there were some Devil Incarnates on High watching over the derrieres of the Merced County officials.  But, I was shocked that the FBI Agent slipped and blurted out who it was.

The FBI Agent catching his blunder told me to hold on a moment.  I heard him calling, “Hey Joe, Joe!  Can you come over here for a quick moment.  I’ve got Gene Forte on the line!”  It was like he was yelling, “Incoming!  Incoming!”

I suspect that “Joe” is FBI Agent Joe Holzman who I had provided evidence to in a letter of April 25th, 2011 of Merced County Grand Jury tampering by the Merced defendants.

(Note:  The real meat and potatoes revealing the on-going cover-up by wayward public officials is gained by reviewing the evidence contained within the letters sent to the FBI over the past year. )

After a few minutes of a muffled phone, the FBI Agent repeated they had special instructions not to investigate any evidence of criminal conduct by Merced County official defendants.

The ludicrous excuse morphed into it being due to my pending civil lawsuit.

The FBI Agent stuck the foot of US Attorney Wagner further down Wagner’s throat by saying it was Wagner’s “normal practice” not to investigate criminal conduct by public officials while they had a civil lawsuit pending against them by a citizen.

Having not just falling off of the turnip wagon, I explained calmly and rationally what utter B.S. that was.

It was absolutely a denial of my equal protection under the law.

I refered the agent to the FBI website where it clearly says that color of law abuses of police misconduct and police brutality were listed under their duty to investigate.  The FBI Agent wholeheartedly agreed.

He said he understood my frustration due to the instructions of the US Attorney to “not get in the middle of it”, but alas,  there was nothing they were going to do about it.

The FBI Agent emphatically directed to me to address the issue of the disappearance of my Citizen Complaint in my civil Federal lawsuit.  I told the  FBI Agent that I would point it out to Federal Judge Anthony Ishii, but I emphasized that I did not have any remedy in the civil lawsuit for the criminal activity by the Merced defendants.

I told the FBI Agent that my civil lawsuit did not negate the obligation and duty of the FBI to investigate evidence of criminal activity by the Merced County public official defendants.

After a few minutes of going around the same track , with the FBI Agent losing more ground by the second,  some really wild and unsound legal assertions were made by him.

The FBI Agent said in defense of the Merced County defendants that, “The disappearance of the Citizen Complaint at worst would be considered a administrative error, not a crime in as of itself.”   I retorted that a purported administrative error intentionally made to conceal a crime was a crime.

Herr Wagner (Cntr), with comrades Merced Defendant DA Morse (lft), Merced PD Chief Norm Andrade (Rght.). Andrade buried the Merced PD investigation #11-18328 of Merced Grand Jury tampering by Defendant Merced County Counsel James Fincher.

Even after my pointing out the provisions of California Government Code 1222 and CA Penal Code 835.2, he stuck to his proverbial guns and we both decided we had enough.

I offered for the FBI Agent to contact my criminal attorney Mr. Larry Cole to verify that he sent a letter to the Merced County defendant DA Morse to investigate the crime of Merced County Grand Jury tampering by the Merced County counsel defendant James Fincher.  I told him that Cole would verify there was no response from Morse.

Now, please understand that Cole is not so naive as to think Morse could investigate the matter due to Morse’s obvious conflict.  But, it would force Morse to admit that he had a conflict.  It would force Morse’s hand to forward the investigation to a neutral independent prosecutor (certainly not now the US Attorney).

I told the FBI Agent that Cole would verify many of the specious activities of the Merced County defendants…..but he flat out didn’t want to hear about it.

The FBI Agent was emphatic about my bringing the disappearance of the Citizen Complaint up in my civil case.

He said it was the only remedy I had available to me since they were ordered to not be involved.

I did not agree with his position, but given his directions, I filed what is called a Motion for Request to file  a Sur-Reply in my Federal case to bring it to the attention of Judge Anthony Ishii.

The Sur-Reply requests that based upon the new prima facie evidence of the destruction of the Citizen Complaint by the Merced defendants, I be allowed to amend my complaint to include such cause of action against them.

The sur-reply attached exhibits wherein DA Morse admits that he could not ethically or legally investigate or file any criminal charges against me as he did (Refer to Audio Exhibits 14-14.7 below).

It requests that Judge Ishii, under his discretionary powers and according to his  California Code of Judicial Ethics Canon 3 D, address the evidence of criminal activity by the Merced defendants by reporting it to authorities.

I also reasonably threw in the kitchen sink by requesting that Judge Ishii consider convening a Federal Grand Jury, or request an independent investigator be assigned concerning the specious directions of the US Attorney and the FBI.  There is little doubt that I have been treated with “deliberate indifference” by them.

I have busily been sending copies of the filed Sur-Reply to public officials requesting that they take action for the protection of my civil rights.

I have sent a letter to Congressman Dennis Cardoza  (209-946-0361) who thus far has been, as we say on the farm, “as useless as teats on a boar”.

Cardoza has continually looked away from the crimes enacted against me by Merced public officials in retaliation for exposing public official corruption in the Badger Flats Gazette.  Perhaps, he also is just following the marching orders of  Herr Wagner.

The Merced defendants banter endlessly that I am a public figure and have access to the media.

I say not so… and to prove my point, I have provided news organizations such as, CBS 47, and KMPH TV 26 with copies of the sur-reply.

I have asked that they investigate the story that is in the public’s interest and of national importance.  I mean, how many times have you heard  about journalists being up in arms about a fellow journalist’s Freedom of Speech and the Press being under attack?

So, what about me?  I and the Badger Flats Gazette have been credited nationally for breaking the investigative story that led to Los Banos Mayor Tommy Jones being busted by the California Fair Political Practices Commission for taking bribes from a developer.

I did appreciate it.

But, I certainly would have also appreciated if they would have reported that I received death threats made for Mayor Jones afterward.  I say they  were actually made by Jones  and covered up by the Merced County defendants (including McClatchy Newspapers)

Are they not paying attention because I am saying that McClatchy Newspapers is involved in covering up the attack upon me by public officials in California?  What do you think?

Laws say that if I am to be considered a public figure, I can call the media up, and they essentially come running.

Well, in the most simplistic terms, if the media that I am providing my information to report upon it, then I am public figure.  If they don’t, then I’m not.  Regrettably, I think my effort at getting them to cover the story is going to be as fruitful as a Chinese Fire Drill.  But, hope does spring eternal!

Thus far, the news manager Chad McCollum of CBS 47 has deleted the emails to him unread.

To tell you the truth, I think that news organizations are not reporting upon my Federal lawsuit because McClatchy Newspapers (Merced Sun-Star, Los Banos Enterprise) are  defendants with the Merced public officials.

I’m alleging that McClatchy Newspapers has worked in a conspiracy with the Merced defendants to conceal civil rights violations against me.

Facetiously I say, now who would ever imagine that?  Personally, due to recent Gallup polls indicating that 85% of Americans distrust the media I think about 85% of  Americans can imagine it.

I  have sent a copy of the Sur-reply to Mr. Leon Panetta, now Secretary of Defense and head of the Panetta Institute for Public Policy.  I am accusing Panetta of being the Master puppeteer of US Attorney Wagner.

I am publicly challenging Panetta and his Board of Directors of the Panetta Institute for Public Policy to respond.

I’ve asked them to disprove my public accusations by taking action to have these egregious matters investigated.

From what I personally know of the punishment submitted to me by Monterey public officials for forcing Monterey judges into retirement who were cronies of Panetta (who lives in Monterey), it’s a bunch of phooey.

The United States sends our soldiers to die in foreign countries to prevent suppression by governments of  Freedom of Speech.

Currently the actions of the FBI,  US Attorney Wagner,  the Merced County defendants,  McClatchy Newspapers, and Mr. Leon Panetta indicate they’re acting like a bunch of self righteous hypocrites more akin to the tyrannical governments we fight against.

I should point out that Panetta hails from Monterey, California.

In 2003 I was contacted by Panetta asking if I would forget about my catching the Law Firm of Fenton and Keller that his son Christopher is an attorney with fixing a real estate trial with Monterey Judges.

Since I’m on the subject, I might as well mention that Panetta was the White House Chief of Staff for President Bill Clinton from 1994-1997.

Judge Anthony Ishii was nominated a Federal Judge by President Bill Clinton in 1997.  I have no reason to believe that Judge Ishii would violate his duty to be an impartial judge, or that he would take any personal offense to my putting Panetta on the HOT SEAT of public accountability.

Welcome to the Hyatt-Hitler!

Seems like I’m not the only one that has had trouble with the Hyatt-hitler group.

Ms. Pamela Geller of the Atlas Shrugs Foundation has had it with the Hyatt Hotel in Sugar Land, Texas also recently.

But, quite frankly I think it pales in comparison to what has happened to me and my family…and is still happening.  My First Amendment Rights are being trampled by the corrupt public officials that I am exposing and are now attacking me with the aid of the nation’s third largest paper, McClatchy Newspapers.

Late in the evening of March 5th, 2010, I and my family left our home in Los Banos, California,  after our attorney told us that we should seek safety and protection from another police jurisdiction outside of the City of Los Banos and Merced County.

The Los Banos Police Department and the Merced County DA were covering up that we had received death threats from then Mayor Tommy Jones that they were going along with.  Jones had been found guilty 30 days earlier by the Fair Political Practices Commision (FPPC) for taking loans under the table from a developer.  I was the one that filed the complaint and pressured the FPPC into investigating the matter.

The Pleasanton PD Officer told us that the reason the Hyatt was throwing us out of our paid room was because the manager of the Hyatt did not like my speech at the Los Banos City Council meeting or my writings in the Badger Flats Gazette.  (Note:  I wasn’t walking around the hotel giving my paper out and I wasn’t making any speeches.)

I have every reason to believe that the Los Banos PD told the Pleasanton PD to rough me up and make it look like I needed mental help in order to help cover for them and their covering up of the death threats.  Watch the YouTube Video Terror at the Hyatt-Hitler!

EMAIL TO A FRIEND ABOUT HYATT TERROR

My sensitivity to the matter is that I realize how difficult it is for anyone to phantom that my act of giving one of the “Death Threat” Badger (pg. 3) casually to one of the clerks at the Hyatt Summerfield Suites caused them to call the Pleasanton Police Department to try and have us forcibly removed from our room.

BRIEF SUMMARY OF EVENTS

We checked in on March 6th, 2010, at about 4:30AM and pre-paid for two nights.   At 9:45AM, I woke up because I wanted get to the breakfast buffet (before it closed at 10:00AM) and grab some food to bring back to the family who was still asleep in the room. (Note:  There were only two guys sitting at a table drinking coffee and one woman sitting near the front desk when I left.)

I had three Badgers with me that I had been proofreading like I usually do for a few days after I first print them to keep cleaning down typos, etc.

On the way back to my room, going past the front desk, I left one casually (without discussing it) with the attendant.   There were also two gentlemen talking over coffee about the front page news of the day, something about Pleasanton Police Corruption.  We happened to chat about it briefly between the adjoining tables, and I gave them a copy of the Badger when it touched upon the same subject.

Another hotel guest sitting near the desk asked what it was, I told her, and she asked if she could have a copy.   I gave her the last of the three I had.

It wasn’t soliciting subscriptions or money, it was a traveler engaged in a brief conversation with three other travelers staying at the same inn.

When I returned to the room, I received a call from the assistant manager (who I never met or spoke to) asking me if I had a complaint about the food.   Surprised, I said no, not at all.  She then (out of the blue) told me that we had to leave.

I told her that was ridiculous and asked her why.  She gave no response and told me that I had to leave, or she would call the police.  I told her that we would not leave unless she could provide me some rational foundation besides some blanket accusation. She then hung up the phone.   Within five minutes, there was knocking on our door that had the DO NOT DISTURB sign up.

I asked who it was; she said it was the manager, and that I had to leave. I told her to please not disturb our occupancy, and if she was going to try and force us out, I was going to call the Police. It was at that moment that there was a louder pounding on the door saying it was the Pleasanton PD.  (Note:  She had brought the PPD with her.)

I cracked the door open with the security latch still on and asked them what they were there for. The PPD said that I had to vacate the room due to the manager saying she didn’t want us there. I then explained to them calmly that we had our rent paid, we had done nothing to violate our peaceful occupancy of the room and to please call the LBPD.

…..and they could verify that we were in route seeking police protection from another jurisdiction due to the death threats from Jones that the LBPD was covering up.

My attorney had actually been calling and faxing other jurisdictions through the night.   I told them if they had eviction papers, or a search warrant of some kind, or could provide me a legal reason as to why they were there to take us from the room to please do so.

The officer said that because the manager wanted us to leave, we had to leave.

(Note:  That is absolutely false and not according to any law in the United States).

The PPD then said they feared that my family might be in danger from me. It was at that time that I said, “Excuse me, that’s outrageous and insulting.

I’m going to close the door and go to the window.  I then went to our window, opened the drapes with Eileen and the kids all standing there telling them we were all fine but to please leave and stop bothering us, we were starting to feel frightened.

I asked them again to call the LBPD and read the “Death Threats” Badger which explained what we were under torment from.  They kept saying they were not going to call the LBPD and that I was in Pleasanton. It was at that time that we heard the door unlock with a pass key, and they were starting to stick a sharp object through the door to break the security latch off.

I ran back to the door and forced it closed, the jamming device pierced my hand.

There was no way in hell that I was going to let these police officers that were acting not according to law, but as thugs breeching my room (which was our legal domicile).

Who knows what they would have done to me, Eileen, and my children behind closed doors……dropped a bag of drugs in the room?   I certainly knew they knew they were already in trouble when they breeched that door.

I continued to hold the door tight, trapping the jamming device with my hand bleeding and covered with a towel, and spoke through the door for one hour and 33 minutes.  (It is all on digital audio and video that prove everything I say.)

Across that time, there came a total of about eight officers standing outside of our room. Finally, an officer came that said he had called the LBPD (that was a lie, we found out later that they had called the LBPD prior to their coming to the room with the manager).

I asked them why in the world were they  acting as they did?  It was scaring us and the kids. He then said he would remove the jamming device from the door with him agreeing that they were no longer going to try and breech the door.

I then released the pressure against the door so they could do so. It was agreed that we had done nothing wrong and that we should have not been disturbed. I then told them through the door (cracked open with the security latch still intact) that my family and I were going to come outside and sit by the pool so I could show the kids, who were terrorized, that they didn’t have to fear every police officer they met.

I then went out with Gaby, Jordan, and Juston…Eileen and Noel were still in the room. I was speaking with one of the officers asking why in the world had they conducted themselves as they did.  After about five minutes, I heard Eileen screaming by our room that was about 15 yards away (we had a bottom suite near the pool).

When I went there, she was standing between two big officers who were blocking the door.  They had reached around behind her when she walked out and pulled the door shut…..they didn’t know that Noel was still inside.

Eileen was frantic for Noel who was now screaming from inside the room. One officer had his hand on his service revolver; the other had pulled out a stun gun. I calmly said, officers back down, while I approached and took Eileen by her hands from in between them.

I then went back to the officer that I had been speaking to and asked him, how in the world did he expect me to not have to address this matter without a lawsuit?  A few minutes later while still speaking to him, a new officer, the sergeant watch commander, came out by us.

He was grinning like a cat eating poop, while holding Eileen’s purse in one hand and my jacket in the other while asking “Whose are these?” I walked up to him and said, “Now, you have gone further over the edge, you’ve broken into our room and stolen our items.  Have you lost your mind?”   I still continued to be polite to the officers but it was getting harder (all of this is on audio and cell phone video).

Then the Sergeant who had grabbed our items from the room, said “Gee, your hand’s bleeding, it looks like you need medical attention.” I told him no, I’m fine, I will take care of it.

Then all of a sudden, he started laughing saying “No, we think you do!”  and five officers grabbed me, pushed me down…….then lifted me up……. and slammed me down onto a gurney that they had brought in from the back.  They then handcuffed me to it.

All the while, I actually stayed relatively calm saying that I was not fighting them, or resisting arrest.

They said they were not arresting me, they were getting me medical help. I was then rolled out to an ambulance in the parking lot.  When they checked my blood pressure it was 191/135. What happened next was tortuous.

The ambulance attendants refused to give me any aspirins or anything to try and lower my blood pressure, or stop my blood from thickening.

The ambulance attendees remained parked for about 30-45 minutes with the officer that had instigated this entire cabal standing outside the doors to the ambulance which were open…they were talking back and forth loudly and  intentionally for me to hear, laughing and poking fun at me saying that they thought I was a nut case in claiming that I was under threats of death from a Mayor….and that they had had death threats from mayors themselves, etc.. I kept begging them to please bring me to the hospital due to my open heart surgery and the elevation of my blood pressure.

I actually thought I was going to have a heart attack and I was not going to see my family again. They continued laughing back and forth, making fun of me saying that it really sounded like what I really needed was a good shrink.

I found out later that while this was going on, Eileen and Gaby were in the room. The two officers that had blocked the door were telling them if Eileen did not leave, Gaby was old enough to take care of the kids, and they would arrest Eileen.  They said that the manager was going to credit back the payment on the room.

The officers told Eileen that they were sending me over to a psychiatric ward in Concord for mental evaluation. Eileen told them there was nothing wrong with me and that, in fact, the LBPD had tried that just the day before by having the Merced County Health Department call us and evaluate me on March 5th, 2010.

(Note:  When I provided MCHD with the death threats we had received, they gave me a clean bill of health and asked if I was okay.)

Who in the heck would not feel concerned or stressed over getting something like that…..as you pointed out, it was not written by a high school kid…..I know it was actually done by Mayor Jones and his attorney and delivered through the kid they used as a shield.  When I asked MCDH, “A person would be crazy if they weren’t concerned, right?”, they agreed.)

When Gaby pulled from her purse a recorder she had going, Eileen and Gaby say the officers’ mouths dropped and they looked concerned. Finally, the ambulance drivers and the cop standing outside, after realizing that I was not going to let them goad me into losing it, brought me over to the Pleasanton General Hospital. My medical bills for the overnight stay with the heart checks cost $32,000.00 and are still climbing.

Due to my heart attack, I have been unable to have health insurance for myself.  Thank god I was able to get it for the family. All of this matter and the harassment of me by the Pleasanton Police Department were triggered by the assistant manager reading the Death Threat publication, which is as legally protected under First Amendment rights as the New York Times, and then the PPD talking with Commander Brizzee (or other LBPD officer under direction of Brizzee) prior to the PPD coming to our room.

I also want to say that a PPD Officer told Eileen that he recognized our name, because his son goes to Central Catholic High School with our son. He said that he read a copy of the death threats and was shocked at the conduct of the LBPD not arresting Donaldson, or questioning the Mayor.

He told Eileen that she had to contact the LBPD and tell them she was back in town so that if anything happened to her or the kids while I was gone, the LBPD would be responsible.

I wanted to take the time to explain this in more detail to you, and I have done it on the morning of Mother’s Day.  It is very painful for me to re-live, but what you think of me is important to me.

I would never want you to think that I would ever put my family at risk…I am in a mode now that I have got to stop this beast once and for all. My daughter starts LBHS next year and Jones teaches there…and of course has minion students there he has blinded.

Eileen and I have not yet decided if we are going to stay in a town that has lost all sense of American values.  If we do leave, we will continue exposing publicly the corruption that every citizen needs to be aware of. It should also be pointed out that I WAS NOT ARRESTED BY THE PPD, meaning that I committed no crime by not letting them into my room.

They committed a violation of my civil rights by trying to break into my room without probable cause, or a legal right to do so, this isn’t Russia!

IT STARTED IN LOS BANOS WITH THE LOS BANOS PD, MERCED DA, AND THE MAYOR

You should realize that on March 3rd, 2010, I was prevented by a TRO of Jones from entering City Hall and going up to the open mike at the City Council Meeting to tell citizens about the death threats. (Note:  The TRO should not have prevented me from entering City Hall or the council meeting……but the LBPD did not want me to play the recording that showed they are involved in covering up the death threats for Jones.)

The main LB newspaper hasn’t told citizens about the death threats made to me. I was put under Citizen’s Arrest by the closet alternate lifestyle principal (McGhee) of Our Lady of Fatima Catholic School on February 28th, 2010, for Criminal Trespass. Please remember that the LBPD said they could not arrest me themselves because I was not trespassing or causing any disturbance.

Los Banos Police Department with Commander (now Chief) Gary “The Fixer” Brizzee (center) at the helm, forcing Forte away from City Hall to prevent him from speaking at the City Council Meeting. Why? They knew Forte was going to play recordings of ex-Chief Knapp and others admitting no investigation was conducted regarding Jones’ involvement in the death threats against Forte.

The LBPD goaded a willing McGhee who had already  had discussion with LBPD Commander Brizzee (a fellow OLF parent and coordinator of the cover up) and did not want me to tell OLF parents on the cooking crew about the death threats. Aftermath:  McGhee was forced to retire (or was terminated).

The Citizens’ Arrest charges have been pending against me since  April 2010.  No way do they want to go near a jury.

They know that I have a complete audio recording of what took place from the minute I arrived at the breakfast through the harassment of me by them which took over a half an hour.    Here is a sample clip.

There are going to be some holier than thou Our Lady of Fatima hypocrites who showed the most un-christian like conduct that could be imagined.   They know who they are, and I can feel them quivering as the story unfolds.

Think about it, these fellow Catholic School OLF parents didn’t care about the death threats my family received from the Mayor?  If they were at the crucifiction of Christ they would be sharpening the nails and asking the Roman guards if they needed any refreshments.

The recording proves that I was being harassed by McGhee and the police who did not want citizens to know about the death threats by public officials against me they were covering up.

McGhee is in hiding from service from the Federal Lawsuit I have filed against her and other law enforcement in Los Banos and Merced County.

Actually, I’ve heard she hasn’t been seen much at the school since April 21st, 2010, the day after my letter of  April 20th, 2010, letter to the attorneys for the Diocese.   (Note:  McGhee announced her plans on retiring from OLF the morning of April 21st, 2011.  When you read the letter you will understand why McGhee had an ax she wanted to bury in my head.  (Hint:  It involves child and lesbian pornography that was discovered on a computer  of  hers and her lesbian partner, the OLF 8th grade teacher, Ms. Kathy Nerell, that they donated to the school.)

The LBPD officers who came with McGhee said they could not arrest me themselves but would only put me under Citizen’s Arrest for McGhee.

The LBPD said I was not trespassing and it was totally up to McGhee.  The arrest was done to discredit me to the public at large and cover up what the LBPD was covering up for Jones. I hope that better explains what took place in Pleasanton………….it is not easy for me to talk about.

When asked for a copy of the police report of the incident that lasted over two hours this is what we received…basically they told me to go and well–you know.

Merced County Civil Servants

Get to know some of the usual suspects you’ve had leading the way for you in Merced County.

Here are some clips from a video deposition of  ex-Mayor Tommy Jones of Los Banos.  (Jones Deposition Clips)

Jones went up in flames when I wrote about his arrest for crack cocaine when he was a LB City Councilman (V is For Recall).

I also suggested how it was  covered up for profit by ex-disgraced Merced County District Attorney Gordon Spencer.

Jones did his typical race card routine with thrusters under the banner of “don’t anybody say anything against a black public official because we now have Obama in office.”

After I wrote about Mayor Jones being arrested for possession of crack cocaine when he was a City Councilman Jones started telling people that he knew for a fact that I was a dangerous member of the Ku Klux Klan.  Jones, the moron, actually told that to Mr. Clinton Galloway, a fellow African American, my best man at the marriage to my Chinese American wife, and friend for forty years.

The problem that Jones had was that citizens knew that I was not, or had ever been a member of the KKK or any racist group.   Jones, unrelenting or unconstrained by law enforcement, became more furious when I got him busted with the FPPC for taking undisclosed loans from a developer (Power of the Written Word).

I then publicly jammed that race card right up Jones’ derriere.  Jones cut off my microphone early and had me thrown out of City Hall under threat of arrest when I was reading the Recall Petition that had been filed.

The Enterprise didn’t print a word about it.

The cherry busted when Jones (I say) got his high school student, Anthony Donaldson Bates to send my family and I death threats (Death Threats) thirty days after he was busted by the FPPC due to my my complaint.

The threats read like they were written by an adult, or with adult direction from individuals with something to gain such as Pride, Jones and Ratliff.

The death threats were supposedly for me calling Jones a “lying nigger” eight months before at a City Council meeting.  I am now required to say that  I did not call Jones a lying nigger.

I refuse to say lying “N-word”  The word is what it is.  If one other person on the planet can say it, I can too.

My life long relationship with the Galloway Family, my black brothers and their parents, speaks for my not being a racist.  Jones and Pride hate me for saying that I am part of a black family.

Merced County and LBPD law enforcement had the same motives as Jones in wanting me deterred from writing about their false arrest of me for exposing their corruption.

Law enforcement preventing an investigation into the death threats must have seemed like a pretty good idea to them.

It certainly would be enough to deter a person of ordinary firmness from exercising his constitutional rights.

The now pending Federal case of Forte v. McClatchy Newspapers, Merced County, et al.  relies upon the First Amendment Right not to be retaliated against (Michell v. Horn, 318 F.3d 523 (3d Cir.2003)

The vile attack upon me orchestrated by public officials and McClatchy Newspapers had the common interest of silencing me.

This is easily evidenced in the Commentary by Gene Lieb of the Los Banos Enterprise saying “Mayor Owed Apology“.

It was not even remotely truthful.  As you read Lieb’s Commentary, keep in mind that he had also the Angel Whispers tribute to Carl Galloway in his hands.  Watch the video and see what I really said.  Lieb was present when I was speaking.   How could he get it so wrong without it being intentional and with malice to shut me up?

At the same time,  African American Los Banos Enterprise reporter Corey Pride,  who was a close ally of and agent for Jones, was posting that I am a known racist,  and that citizens should close their doors to me, etc..

Pride was reporting upon my arrests without an interview with me leaving citizens to believe I was charged with three felonies which is absolutely not so.  District Attorney Larry Morse said that he could not investigate or file charges against me…so why did he?

There has been a Merced PD Report filed for tampering with a Grand Jury investigation of my complaint by Merced County Counsel James Fincher a subject under investigation.  The investigation focused upon the events causing the alleged false arrest charges filed by DA Morse.

Stanislaus County Deputy Randy Watkins has said there was evidence of jury tampering by the Merced County Counsel Fincher and that the Merced PD must forward it up to the DA who can then send it out.

Modesto attorney Mr. Larry Cole, who is now my fourth public defender, was requested by me several weeks ago to prepare a written request to have the Merced DA take action on the Police Report by sending it up to an agency that does not have a conflict.  It still has not been done and I have requested Cole to do so again.

Pride made it clear that he would not interview anyone concerning their Recall of Jones if they were seen with me.

You can hunt through the ranting racist posts made by City Man, Corey Pride, Los Banos Enterprise that were made on a now closed site called OurLosBanos.com (Forums No Longer Exist).

Ms. Caryn Cox of Candlelight Realty, and a past candidate for Mayor and  proponent member of the Recall Committee of  Jones, said that members of the Recall Committee  did not want to associate with me because they feared Pride would write bad things about them and not write about their stories.

The Enterprise/McClatchy Newspapers knew Pride was writing this trash, and they were supporting it.  I kept informing McClatchy Newspapers’ attorney Mr. Karl Olson of Pride’s conduct and their ratification of it with never a response.  They were not telling the public that they were defendants at the time in a lawsuit in Federal law suit with me in San Jose.

Charles Guest, who was the owner of the site (OurLosBanos.com), is now working at the Los Banos Enterprise.  Guest closed the site after I told him that I was going to expose that his site was a group of Jones’ supporters spewing vile out to the community about me.

I am then kept from going into City Hall, by then Los Banos Cmdr. Gary Brizzee, to tell about the death threats.  The Los Banos Enterprise doesn’t print a word about it.  They thought it was important to demand that I make a public apology (for something I didn’t say, i.e., calling Jones a lying nigger), but then they do not report a word about what I allege were death threats to me for allegedly calling Jones a “lying nigger”.

Again for the record, I didn’t call Jones a “lying nigger”.  I just repeated what the Galloways said they thought Tommy Jones was for saying that Clinton Galloway lied under oath that Jones had told him that he knew for a fact that I was a dangerous member of the KKK.

Black racists Jones and Pride throw the Race Card and Forte makes them eat it.
