After my report was submitted to the defense attorney, DA Marita Carlson took a plea deal for two misdeameanors that will be expunged. Judge Marc Garcia expressed amazment how all of those felonies could be reduced to two piddly misdeameanors.

Rather then trying to explain the police miscreants illegal actions, one of whom feloniously assaulted his wife and was arrested and did 11 months in jail, she merely retorted “in the interest of justice”.

“In the interest of justice”. What a handy dandy catch all phrase showing that justice is not blind, but merely looking the other way when convenient when applied to prosecutors.

I am the private investigator that is mentioned in many of Gene Forte’s documents and motions. I was hired by one of his conflict public defenders. I had never met Gene Forte prior to being hired (Note by Moderator Gene Forte: I think we might have met once before you were hired by Larry Cole when you spoke to me about another case you had in Los Banos when I was in Patterson) . When I got a copy of the case with police reports, I began contacting persons in the Los Banos area. All of the persons had a more than favorable opinion of Mr. Forte.

As I began to read and dissect the police reports, I found numerous lies and false statements made by sheriff’s deputies, assistant district attorneys, court clerks and the pro tem judge.

The most blatant documented and video tape proof of a deputy that filed a felony false police report was taken to the Merced County District Attorney’s office.

The newest chief deputy DDA came down to talk to me. I furnished him a copy of the false report filed by the lying deputy and provided a video showing his crime. The DDA began to make excuses for the deputy and when I did not buy his patronizing attitude, he took the evidence and said he would give it to his chief investigator. I told him that he had everything already the deputy should be suspended from duty, arrested, charged and prosecuted.

Since he did it this time, he has undoubtedly lied in innumerable report to wrongly convict and harass many other citizens. Well guess what? I never heard another word from the DA’s office. IMAGINE THAT!!! Gee “Eric”, if you took your head out of your rectum could you smell a cover up? For you to author an email that vitriolic without examining all of the documents and listening to the recordings, it would appear to me that you “Eric” are the one that needs the medications. My, my, such misplaced anger. Maybe a little anger management should be in your future.

BTW “Eric”, the current public preten, whoops, I mean defender is named “Eric” also. After I gave him my report showing all of the lies, deceptions and contradictions in the police reports, he fires me because I am not going along with the program to silence Gene. Smell anything yet “Eric”?

I am sending this in an email to “Eric”. “Eric”, if you want to get together some time to look at the cover-ups being perpetrated by the egregious shameful dregs of law enforcement, let me know.

Far from it. Gene Forte has the legal minds in Merced County so out classed in legal knowledge that they are trying every maneuver, most of them illegal to silence Gene and make all their crimes, yes crimes, go away.

I was hired against the wishes of one of the latest public defender conflict attorneys but at Gene Forte insistence. There had been no investigation of Gene’s case prior. I contacted many people outside of law enforcement in the Merced/Los Banos areas. Almost all of them were forthright with their answers.

Trying to meet and contact members of the law enforcement community, I was met with a stonewall of silence, you have to talk to county counsel before I can talk to you or I don’t want to make a statement. IMAGINE THAT!

I then began to analyze and dissect the pages and pages of the crime reports. What I found was more then amazing. Without going into detail here but I could certainly show any interested party at least 16 blatant lies, distortions, inconsistencies and false statements in the reports.

The liars, perjurers, people that did not get their “stories” straight include law enforcement personnel, courtroom personnel, court clerks,assistant district attorneys, selective witnesses picked by the law enforcement personnel and a “pro tem judge”.

I am talking serious false police reports to try to substantiate and validate the charges Gene Forte was falsely arrested for. I will note now that I have to close this before it turns into a novel, I found a deputy sheriff that perjured himself in the report he wrote. I have courthouse video tape verifying he blatantly lied in his report.

I took the information and video tape proof to the Merced County DA’s office. I spoke with Chief DDA Carroll. I showed him the proof and he immediately began to try to make excuses for the actions of the deputy. I told him that I wanted the deputy arrested, fired and tried for his crime. DDA Carroll said he would give it to his chief investigator Patrick Lunney. I have never been contacted by the DA’s office. So they are part of the coverup of failing to address criminal conduct by one of their own.

Oh, by the way. The current public defender fired me from the case and slandered me by telling Gene Forte in a recorded telephone call that I “cannot be trusted”. You figure why I can’t be trusted.

I am closing due to length but have much,much more to say about the illegal and deceitful actions of the law enforcement personnel in Merced County.

It did bring a tear to our eyes and the renewed hope that there are people sympathetic to us and understand I have no choice but to fight to the end.

It is for my children, so that they do not ever have to think their father’s heart was crushed, or spirit broken.

I am sadly not comfortable leaving my name here, but I have followed your horrific story for quite some time now having made my way, by accident, to your site while manically researching MPD’s history of corruption that might provide me insight into my own, decidedly less complex than your own, incredible mistreatment by them. I have thought often of your story when your updates waned and have found myself wanting to reach out to you but more than a little afraid of potential repercussions (I’m sure you can understand). I have finally decided, after reading the comment posted above, that I do not wish to be further victimized by them and as long as I continue to allow my fear of their abuse to dictate my behavior I’ll remain a prisoner, perhaps even a passive participant by providing only silence. I needn’t trouble you with my story – that’s not at all why I am here – I simply want to convey my sympathy for you, your incredibly brave family, and thank you (as sincerely as one can hope to do over the internet) for your tireless and unrelenting pursuit of the representatives of our government whose contempt for you and the justice you are so clearly owed I find it is impossible for me to be anything but sick, seething, and steadfast in my support of you and your aim. I hope that soon the dam breaks, the truth flows, and the filth of these miscreants is washed away to reveal (I hope) that there is still some of our system unscathed and still salvageable.

—It’s not mental illness in this case that one should be so afraid of, but rather the devotion to the delusion that the fetid, rotting, systemic infection, made of our failed officials should be dismissed as some symptom of psychosis instead of seeking relief from it.
